Operation Reboot – Seven Arrested in Operation Against Child Porn Distributors in New Jersey

Seven men and one juvenile from Bergen County have been arrested after a months-long investigation conducted by the Bergen County Prosecutor’s Office determined they used the internet to spread child pornography.

Following the investigation, which prosecutors called “Operation Reboot,” investigators executed multiple search warrants and seized roughly 32,581 files from online accounts and electronic devices belonging to the culprits. The files depict nude and semi-nude child victims as young as infants to pubescent children in sexually explicit poses, including child rape videos and images, according to a news release from Bergen County Prosecutor Mark Musella.

One of the defendants, Harry J. Burks, Jr., 36, of Hackensack, was arrested on Thursday, August 20, after an investigation revealed that Burks, Jr. possessed approximately 3,293 digital files, a majority of which he acquired while allegedly accessing the Dark Web that depicted nude and/or sexually explicit prepubescent and pubescent children. He also allegedly engaged in sexually explicit online conversations with an underage girl on social media. He was charged with Endangering The Welfare Of A Child, a third-degree crime.

The following defendants were arrested within the past two weeks and charged with the following:

Justin K. Kinchen, 21, Elmwood Park; Distribution of Child Pornography in an amount greater than 1,000 files, a first-degree crime; Leader of a Child Pornography Network, a second-degree crime; and Possession of Child Pornography in an amount greater than 1,000 files, a second-degree crime. Kinchen allegedly downloaded, viewed, possessed and shared about 17,731 digital files depicting nude and/or sexually explicit children while moderating a private online forum that trafficked in such files. He was remanded to Bergen County Jail pending a detention hearing in Hackensack on Monday, August 31.

Yam Kuen Kwan, 22, of Cliffside Park; Distribution Of Child Pornography, a second-degree crime. The investigation revealed that Kwan shared approximately 50 digital files depicting nude and/or sexually explicit prepubescent and pubescent children. He was released with conditions following an appearance in Central Judicial Processing Court in Hackensack.

Luis A. Ocasio, 37, Garfield, Possession Of Child Pornography in an amount greater than 1,000 files, a second-degree crime; and Distribution Of Child Pornography, a second-degree crime. The investigation revealed that Ocasio viewed, downloaded, and/or possessed approximately 6,447 digital files depicting nude and/or sexually explicit prepubescent and pubescent children, while also sharing a portion of those files. OCASIO was released with conditions following an appearance in Central Judicial Processing Court in Hackensack.

Balthazar G. Torres, 20, Maywood; Distribution Of Child Pornography, a second-degree crime; Possession Of Child Pornography, a third-degree crime. The investigation revealed that Torres viewed, downloaded, or possessed approximately 376 digital files depicting nude and/or sexually explicit prepubescent and pubescent children, and shared 90 such files. TORRES was released with conditions following a first appearance in Central Judicial Processing Court in Hackensack.

Harry J. Burks, Jr., 36, of Hackensack; Possession Of Child Pornography, a third-degree crime. The investigation revealed that Burks, Jr. viewed, downloaded, or possessed approximately 3,293 digital files, many of which he acquired while accessing the Dark Web, that depicted nude and/or sexually explicit prepubescent and pubescent children. The investigation also revealed that he engaged in sexually explicit online conversations with an underage girl he connected with via social media. He was therefore also charged with Endangering The Welfare Of A Child, a third-degree crime. He was released with conditions following a first appearance in Central Judicial Processing Court in Hackensack.

Damian R. Evans, 33, of Westwood; Possession Of Child Pornography, a third-degree crime; and Possession Of Large Capacity Ammunition Magazines, a fourth-degree crime. The investigation revealed that Evans viewed, downloaded, or possessed approximately 5,733 digital files depicting nude and/or sexually explicit prepubescent and pubescent children. He was released with conditions following a first appearance in Central Judicial Processing Court in Hackensack.

Lewyn Concepcion, 21, Rochelle Park; Possession Of Child Pornography in an amount greater than 100 files, a third-degree crime. The investigation revealed that he viewed, downloaded, and/or possessed approximately 150 digital files depicting nude and/or sexually explicit prepubescent and pubescent children. He was released with conditions following a first appearance in Central Judicial Processing Court in Hackensack.

The Juvenile, 16, was taken into protective custody and charged as a juvenile delinquent; Possession Of Child Pornography and Distribution Of Child Pornography. The investigation revealed that the juvenile viewed, downloaded, or possessed approximately 248 digital files, and also shared approximately 13 digital files depicting nude and/or sexually explicit prepubescent and pubescent children. The juvenile was released into the custody of a guardian and scheduled for a first appearance in the Chancery Division, Bergen County Family Court in Hackensack.
